An update to photo policies within our organizations

THE DAILY NEWS and its many partners operates in several countries throughout the world (but we are not factually based in America; the United Kingdom, or Europe). We have a minor operating space in the U.K but that is for an unrelated business that has nothing to do with this newspaper.

Most of our reporters are overseas in America and are protected under U.S law and the like. Briefly, I’d like to spell out what exactly that means for photo agencies and the like.

  1. In America, copyright registrants are a real thing.

Without them, ahem, stat damages cannot legally be sought because copyright was never registered. Copyright registrant numbers are to be provided upon e-mailing The Daily News in reference to images/mirrored on this website. We helped build a third party app that allows mirroring of news stories/images in respect to the originating source. Images are not directly hosted on our servers.

2. In the United Kingdom…

Because we are known to be some of the fastest moving reporters in the world and often have to get a story to publication quicker than most — here are some helpful tips.

A). Chances are and this is highly likely — images are being used in fair use manners as defined by law.

B). We had no idea who the copyright holder in the U.K was and assumed it was fair-use as it had appeared on numerous blogs also uncredited/mirrored. If by chance we find a mirror/image that we are unable to find th photographer for — please notify us. We will happily credit the photographer of an image. Our vendor does not notify us who photos belong only the website in which actually hosts them.

C) General copyright claims

THE DAILY NEWS respects copyright around the world no matter the jurisdiction. However, for images that are not hosted on our website and simply mirrored through a third party app — these images must be taken up with the originating source. This goes for America; the United Kingdom, and the like.

Note: In reference to the U.K…

Section 171(3) of the Copyright, Designs and Patents Act 1988 states that work in the public interest/domain (not a hard task to think of here) are not subjected to copyright. This is one of the very few situations in which we are not lawfully required to abide by copyright in the U.K.

A few examples: If someone were too, say, invade Buckingham Palace.

Make or achieve violence against a goverenment official; parliament; the royal family, Queen Elizabeth II or related entities. These are automatically public interest topics.

Information/photos regarding an act of terrorism.

Breaking News alerts found on social media (simply just ask to be credited).

In some cases, THE DAILY NEWS is willing partially compensate photographers because of the fact that we are mirroring certain pieces of content from other websites to appear on ours. Because we do not fully host images, we are not obligated to fully compensate photo agencies and the like. However because we also started as photographers ourselves — out of respect for photogs.. we would be willing to provide partial compensation for photographs appearing in our mirrors.
