According to the Biden Administration, a new proposal is making its way down the pipeline. In the new proposal, schools across the country would be able to discriminate against transgender athletes in some circumstances but not others.
This means that schools would be able to implement some form of restrictions on transgender athletes participating, however, it would bar the school from barring a transgender individual from playing simply because they’re transgender.
It isn’t immediately clear what these restrictions would consist of.
“The proposed rule would establish that policies violate Title IX when they categorically ban transgender students from participating on sports teams consistent with their gender identity just because of who they are,” according to a public notice from the US Department of Education.
“The proposed rule also recognizes that in some instances, particularly in competitive high school and college athletic environments, some schools may adopt policies that limit transgender students’ participation.”
