Special Counsel Jack Smith to appeal Judge Cannon ‘s far-flung dismissal of classified docs case against Donald Trump

As expected, Jack Smith is set to appeal the ruling handed down by Aileen Cannon that effectively dismissed the case against Trump. Cannon ruled this week that the appointment of Smith ‘violated the appointments clause’ although critics have called her out on that front.

The Lowdown

According to reports, the office of Special Counsel Jack Smith confirmed on Monday evening that an appeal in the case is coming. Smith ‘s office continues to stand by its case against Trump even in the face of numerous attempts by Trump to have said charges dismissed on all fronts as they were ‘political attacks.’

The expected ruling can be read by tapping here. Cannon ‘s ninety-three page ruling dismissed the case on the grounds that Smith was unconstitutionally appointed. Critics have pounced on that claim citing that there have been numerous appointments of such people dating back to nearly the Watergate era.
