Donald Trump has a new victory on his hands. According to a 93-page ruling, judge Aileen Cannon has dismissed the charges against him stemming from the discovery that he stole classified docs.
The Lowdown
According to the ruling, Cannon claims that the appointment of Special Counsel Jack Smith violates the appointments clause. The ruling of course flies in the face of several appointments of such people dating back to at least the Watergate era.
“Upon careful study of the foundational challenges raised in the Motion, the Court is convinced that Special Counsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme—the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law,” wrote Cannon according to a thorough review by the Washington Post.
The ruling is almost guaranteed to be appealed.
