The man Kilmar Abrego Garcia is a protected legal resident (we’ll go over what that means at the end of this article) who has lived in the U.S since 2011. He was deported to El Salvador ‘s notorious megaprison on 15 March.
The Lowdown
An ugly truth is emerging in Donald Trump’s adminisration: it doesn’t care who you are, if the administration doesn’t see you as fit you’re out. In the case of Kilmar he was wrongfully deported to El Salvador after the Trump Administration claimed without merit or basis that he was part of the deadly and infamous MS-13 gang.
On Monday, the Supreme Court affirmed the Trump Administration ‘s glaring error stating that the U.S does not have to facilitate Kilmar ‘s return. The jarring ruling means that the reportedly innocent man will remain in one of South America ‘s most notorious prisons for the time being.
U.S District Judge Paula Xinis issued the order on Friday demanding Kilmar ‘s return calling the deportation at the time unlawful.   Â
This should concern everyone and we want everyone to read the last part of this article carefully.
As defined by the American Immigration Council, a ‘Protected Status Person’ (in reference to someone’s immigration status) is as follows.
‘Temporary Protected Status (TPS) is a temporary immigration status provided to nationals of certain countries experiencing problems that make it difficult or unsafe for their nationals to be deported there”
In the case of Kilmar, by way of a 2019 court order, he received such status on behalf of the U.S Immigration Service.   This means that he is a legal resident in the U.S because per the casew itself he was given the status due to rising gang violence and the liklihood of prosecution if he were to return to El Salvador.
This is critically important because this means that the Trump Administration appears to be openly deporting anyone it does not see ‘fit’ as to be an American regardless of their immigration status.
