Trump’s latest immigration crackdown now includes the use of a seldom-used centuries-old law. According to reports, Trump invoked the Alien Enemies Act of 1798 which allows a President broad deportation powers with a few restrictions.
The Lowdown
USA Today reports that Trump’s latest move has legal scholars and the like crying foul. According to the outlet, Trump declared an invasion on Saturday during ‘war’ citing the Alien Enemies Act of 1798. The act allows Trump new powers to further deport people accused of serious crimes or others.
However, as USA TODAY notes, legal scholars quickly pointed out that despite Trump claiming the use of the law targets the infamous Tren De Aragua Venezuelan gang — some appear to believe that it could also be used against people who are in the United States legally (as the Trump admin is also currently attempting to end birthright citizenship and numerous other facets of immigrating into the United States.)
Those accused
The outlet points out that the five men accused of being members of the infamous and lethal Venezuelan gang have not been proven to be part of the gang. Legal representation for the group by way of the ACLU continues.
The law allows for more deportations with little due process as noted by the New York Times on the matter.
