Trump claims he will issue an EO today to unban TikTok, but here’s what content creators and the like need to know

It’s Monday, meaning America is just hours away from a new President. Donald Trump the incoming President has promised to issue an EO to ‘unban’ TikTok.

However, there are a few problems with some of his claims.

The Lowdown

As many are probably aware, the way government works in the United States is that a President cannot supersede an act of Congress (let alone an act of Congress backed up by the Supreme Court). Donald Trump’s executive order, as many outlets have already noted, only extends the lifeline for TikTok to find a buyer by 90 days.

Trump despite the way he makes it seem doesn’t have the Presidential authority to fully override something that has already gone through the legal process Congress-wise. Trump previously over the weekend proposed a 50% split between TikTok and the U.S. government leading some to suspect that TikTok has bent its knee to the incoming Trump administration.

Trump for what it is worth is the reason TikTok got ‘banned’ in the first place after he previously proposed such moves during his first term. TikTok was not banned because it somehow ‘suddenly’ became a Nat’l Security Issue the person trying to fix ‘the ban’ is the person responsible for the ban.

Specifically inside the law that ‘banned’ the app a 90-day rule was already baked into the law. Assuming TikTok is going by their playbook here, it appears they have already found a buyer because if Trump signs that order later today with no proof — legal challenges are almost certain to follow.
